Do Not Ask:

  • Are you a U.S. citizen?
  • What is your native language?

 

Acceptable: Are you authorized to work in the U.S.? What languages can you read/speak fluently?

Do Not Ask:

  • How old are you?
  • When did you graduate from college?

Acceptable: Are you over the age of 18?

 

 

Disability

Do Not Ask about:

  • applicant’s general or specific health, medical condition, or mental/physical disability,
  • how many days applicant was absent due to illness at previous job,
  • workers’ comp claim history

 

Acceptable to Ask about: (i) applicant’s ability to perform a specific job function, (ii) whether applicant can meet attendance requirements, (iii) non-medical qualifications

Religion

Do Not Ask:

  • What is your religion?
  • What religious holidays do you observe?

 

Acceptable: Can you work on evenings and weekends if necessary?
